Legal framework for fertility treatments in Thailand

IVF and assisted reproductive technology (ART)

Thailand permits various forms of assisted reproductive technology (ART), including in vitro fertilization (IVF). The country’s regulatory framework ensures that all fertility treatments are conducted in a safe and ethical manner. The Medical Council of Thailand oversees these regulations, ensuring that clinics adhere to strict guidelines.

Surrogacy laws

In 2015, Thailand introduced the “Protection of Children Born from Assisted Reproductive Technologies Act” to regulate surrogacy practices. The law prohibits commercial surrogacy and only allows altruistic surrogacy arrangements. Additionally, surrogacy is only permitted for legally married Thai couples or a foreigner with a Thai partner, who are medically proven to need it. In addition, a foreigner and their Thai partner have to be legally married for more than 3 years before getting their surrogacy permission. Foreigner couples are generally not allowed to engage in surrogacy arrangements in Thailand.

Egg and sperm donation

Egg and sperm donation are allowed in Thailand, but they are subject to strict regulations. Donors can be one of the couple’s relatives or anonymous, and clinics must ensure that all donations meet the ethical standards set by the Medical Council of Thailand. However, sperm and egg donation for profit is prohibited in Thailand.

Genetic testing and screening

Pre-implantation genetic diagnosis (PGD) and screening are permitted in Thailand. These procedures help identify genetic abnormalities before embryo implantation, increasing the chances of a successful pregnancy and a healthy baby. As a result of these screenings the families often also get to know the total number of whole chromosomes including the sex chromosome of the baby to be. However, the use of genetic testing is closely monitored to ensure ethical compliance. Gender selection, for example, is officially not allowed albeit the fact that some couples come to do IVF in Thailand for that reason.

Authorities and guidelines

The Medical Council of Thailand

The Medical Council of Thailand is the primary regulatory body overseeing fertility treatments in the country. It sets the standards for medical practices, including ART procedures, ensuring that all clinics and practitioners adhere to the highest ethical and professional standards.

Thai FDA

The Thai Food and Drug Administration (FDA) regulates the medications and equipment used in fertility treatments. This ensures that all medical products meet the necessary safety and efficacy standards.

Accreditation and licensing

Fertility clinics in Thailand must be accredited and licensed by relevant authorities. This accreditation process includes regular inspections and compliance checks to maintain high standards of care and patient safety.

Ethical considerations

Thailand’s regulations on fertility treatments emphasize ethical practices to protect all parties involved, including donors, surrogates, and intended parents. Clinics are required to provide counseling and ensure informed consent for all procedures.  When the donors are anonymous, the anonymity of donors is strictly maintained, and commercial exploitation is prohibited.

Thailand’s well-regulated and ethical framework for fertility treatments makes it a leading destination for couples seeking to grow their families. With high-quality medical care, affordable costs, and a supportive legal environment, Thailand offers a promising option for those considering IVF and other fertility treatments abroad. Understanding the regulations and legal considerations will help you make an informed decision and embark on your fertility journey with confidence. Click here to book your free consultation.
